Privacy policy

1. Controller and contact

The controller is Kancelaria Adwokacka Bartosz Marczyński (Bartosz Marczyński Law Office), ul. Zamenhofa 31, 80-284 Gdańsk, Poland. For privacy enquiries and to exercise your rights, email sekretariat@mnkancelaria.com, call +48 58 344 14 40 or write to the address above.

This policy covers the website and initial enquiries. Information about processing data when handling a particular legal matter is provided separately, according to the services involved.

2. Technical data and enquiries

When a page is displayed, the server receives information needed to communicate with your browser, including your IP address, the requested resource and browser information. Technical data is used to deliver the website, keep it working and protect it against misuse. The legal basis is Article 6(1)(f) GDPR: the office’s legitimate interest in operating a secure, functional website.

If you email or call us, we process the contact details and enquiry you provide to respond and establish whether we can assist. Article 6(1)(b) GDPR applies where you request steps before entering into a contract. For other enquiries, including contact on behalf of a business, the basis is Article 6(1)(f) GDPR: our interest in dealing with correspondence and professional contacts.

Contact is voluntary. Without suitable contact details, we cannot reply. To arrange a meeting, a brief outline is sufficient; please agree a suitable way to share documents and sensitive information before sending them.

3. Automatic OpenStreetMap map

The map on the home page loads automatically, without a click. Map images are requested directly from tile.openstreetmap.org. The provider is the OpenStreetMap Foundation (OSMF), St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom.

This connection discloses your IP address and request metadata to the provider, including browser information, request time, referring source and the map tiles requested. The website code does not obtain your device’s GPS location. The marker shows the office, not your position. The Leaflet library is served from our own server.

We use the map to help visitors find the office and understand its surroundings. The legal basis for providing this feature is Article 6(1)(f) GDPR: this legitimate interest of the office. We do not use the map for our own analytics or profiling.

OSMF identifies itself as a separate controller of data received through its services, rather than a processor acting for the office. Its purposes, retention and rights procedures are described in the OSMF privacy policy. Its privacy FAQ for map users explains its role and infrastructure. For data enquiries, contact OSMF at privacy@osmfoundation.org.

4. Cookies and analytics

We do not run our own visitor analytics, install advertising tools or profile visitors. The website code does not store cookies or use localStorage or sessionStorage. There are no forms, user accounts or newsletter.

Your browser may cache copies of website files and map tiles to avoid downloading them again. We do not use this cache to store tracking identifiers. No cookies were observed from the OSM tiles in the tested configuration. These statements do not cover external websites opened through links.

5. Recipients and processing outside the EEA

Data may be accessed by authorised office staff and, as necessary, providers of hosting, email and technical support. OSMF receives the map-related data described above. Data may be disclosed to competent authorities where the law requires it.

OSMF is based outside the European Economic Area. Transfers to the United Kingdom are covered by a European Commission adequacy decision under Article 45 GDPR.

This does not mean all map tiles are served within the UK or EEA: OSMF uses Fastly’s global network. The linked OSMF documents explain further processing. Fastly’s data processing terms describe onward transfer mechanisms, including standard contractual clauses. You can ask OSMF about the specific safeguards and how to obtain a copy.

6. Retention

We retain enquiry data until the correspondence is concluded and it has been established whether we will work together. Where correspondence is needed to establish, exercise or defend legal claims, the relevant part is retained until the applicable limitation period expires or proceedings conclude. The basis for this additional purpose is Article 6(1)(f) GDPR: our interest in protecting the office’s rights. If we accept your matter, further retention is covered by the information provided for that engagement and applicable law.

OSMF sets the retention periods for data received through its infrastructure in accordance with its privacy policy.

7. Your rights

Subject to the GDPR, you may request access, rectification, erasure or restriction of processing. Data portability applies where the conditions in Article 20 GDPR are met, not to every type of processing.

Where processing is based on legitimate interests, you may object on grounds relating to your particular situation. Email sekretariat@mnkancelaria.com. For data OSMF processes for its own purposes, you may also contact OSMF directly.

You may lodge a complaint with the President of the Polish Personal Data Protection Office. We do not make automated decisions about visitors that produce legal or similarly significant effects, including decisions based on profiling.

“Open in Google Maps” is an ordinary link, not an embedded Google map. Using it opens an external service which receives connection data and applies its own privacy rules. The same applies to other external links.

We will update this policy if the website’s operation or service providers change. Introducing mechanisms that require consent will require a separate assessment and an appropriate choice before those mechanisms are activated.
